WELCOME TO SERJIS S.A.S., WE WILL CALL IT PLATFORM FROM NOW ON. BEFORE STARTING TO READ, WE WANT TO TELL YOU THE FOLLOWING INFORMATION.
- We are a PLATFORM that provides the services of Buying and Selling of Latin American crafts for the world. You can access these services through the website www.serjis.com.
- We will call you USER, quality that you acquire when you access our PLATFORM by registering. And as a user you are the owner of both rights and obligations related to the use you give to our PLATFORM.
OUR TERMS AND CONDITIONS.
1° WE NEED YOUR AUTHORIZATION TO USE THE PLATFORM.
You as a USER give us your authorization, as well as you accept that you have read and understood the terms and conditions when you log in, connect, access or use the Platform.
PLEASE NOTE: If you do not agree with any of the Terms and Conditions or the Privacy Policy, you should not log in, access or use the PLATFORM in any way.
2° PRIVACY POLICIES.
We respect and are committed to protect the information you publish on the PLATFORM.

3° THIS IS HOW YOU CAN ACCESS OUR PLATFORM.
To use the platform, you can access our platform through:
- The website www.serjis.com after that, you can complete the registration process which is described below, when you have the registration ready you can access certain features of the PLATFORM and configure it according to your needs.
REGISTRATION PROCESS
You can do it by registering as a new user, in this case the steps to follow are:
1. Enter NAME, SURNAME and EMAIL.
2. Create a PASSWORD.
3. You will immediately be able to browse the website.
4. Modify your profile to your liking.
Once you register on the PLATFORM, you can modify your profile at any time, as well as the registration information.
4° YOU NEED TO GRANT US SOME RIGHTS.
For the proper functioning of the PLATFORM, you need to grant us the following permissions:
- Use your device's processor, bandwidth, and storage hardware to facilitate SERVICE operation.
- Post advertisements or other information about you and your business partners anywhere on the PLATFORM.
5° OBLIGATIONS AS A USER.
You are obliged to:
- Maintain confidentiality by not sharing your username and password with third parties.
- Be of legal age and provide the information that SERJIS may require to become a User of the Platform.
- You must take responsibility for the veracity of the data provided.
6° SECURITY POLICIES.
We are responsible for the security of the data you provide to us, and therefore we are obliged to:
- To adopt the necessary measures for the protection of your data.
- Contact you when we notice changes in the data you have registered, in order to corroborate the new data and avoid possible fraud.
- To ensure that the data you provide us with is only processed by SERJIS for the purposes described in the privacy policy.
- You, as the owner of the data you provide us with, may revoke the authorization to use your personal data in accordance with the Data Protection laws. To do so, you may follow the steps described in the Privacy Policy.
7° WHEN USING OUR PLATFORM, YOU WILL HAVE THE FOLLOWING RESTRICTIONS.
Consequently, you as a USER ACCEPT AND GUARANTEE:
- You will not violate the terms and conditions of SERJIS.
- You have the legal capacity to accept these terms and form a binding agreement under any applicable law.
- You agree to use the PLATFORM in accordance with these terms and to comply fully with its obligations.
8° HOW TO BUY THE PRODUCT.
Once you have completed the registration and the information in the Profile, you will be able to make purchases of the products available on the platform.
PRICE OF THE PRODUCT
The Platform will clearly inform the User of the price of the product, which will appear in USD, and the conditions it includes and those it does not. Rates vary according to the product you wish to purchase.
PAYMENT METHOD
You can choose credit card payment or PayPal. All aspects related to the use of credit cards, such as their date of issue, expiration, quota or blocking, will be subject to the agreement between the USER and the card issuer.
The values charged for the services will be discriminated in the invoice, as well as the taxes and additional expenses.
9° WARRANTY.
9.1 We will give you a warranty that consists of:
- The quality, suitability, safety and the good condition and operation of the products or services.
- The products are handmade. Therefore, any variation in products or designs should be considered. Each product is unique.
The term of the guarantee will be the following: The products, once received, you can claim (taking into account the point 9.2) in a period of (15) days.
We will inform you if there is a warranty with special term. This warranty starts from the moment you receive the product.
9.2 We will not be responsible for the warranty when the product is defective by:
- Force majeure or fortuitous case.
- The act of a third party.
- The improper use of the good by the consumer.
- That the consumer did not follow the instructions for use or maintenance indicated in the product manual and in the warranty.
- Normal wear and tear of the product.
10° SHIPPING AND DELIVERY COSTS.
During the purchase process you will be able to choose the delivery alternatives, where you will also be shown delivery dates, time ranges and the cost of delivery.
11° OUR DUTIES.
We will ensure that the delivery of the good or service is actually made to the address indicated by the consumer-user and that this has been fully and unambiguously identified.
Allow the consumer to make claims and returns as regulated by these terms.
To inform, before the purchase, the availability of the product, the duration of the commercial conditions and the time of delivery.
12° FAILURE TO COMPLY.
We may terminate these terms or suspend access to the PLATFORM without notice when:
- When you have provided inaccurate, fraudulent, outdated or incomplete information during User account registration and during use of the Platform.
- You have violated applicable laws or regulations, or the rights of third parties.
- With this measure, we seek to prevent any fraudulent activity by the USER as well as protect the safety of other users and third parties.
13° INTELLECTUAL PROPERTY RIGHTS.
The USER understands and accepts that he is the owner of and responsible for the content that he uploads to the PLATFORM, assumes all the consequences that may arise and exempts SERJIS from any legal responsibility, keeping it free at all times from any claim by third parties.
You must bear in mind that:
- You may upload your own content and materials to the PLATFORM.
- You must guarantee that you have all the licenses, rights, consents and permissions of their legitimate owners and guarantee that it does not infringe the copyright of third parties or other rights.
- You agree not to upload content that is in any way illegal.
14° COPYRIGHT.
If you believe that your work or content has been copied or otherwise used in violation of copyright, you must inform us in writing with the following information:
- The contact person authorized to act on behalf of the owner of the copyright.
- A description of the copyrighted work that has been infringed.
- A description of the material that has been infringed and that is to be removed, and information sufficient to permit us to locate the material (including URL address).
- A statement that the information in the notification is accurate and that the USER is the owner of the copyright.
15° YOU ARE LICENSED TO USE THE PLATFORM.
The PLATFORM and its Content are the property of SERJIS. You as a USER of the PLATFORM acquire a limited, non-exclusive license. The license is not transferable.
The license is revocable, that is to say that we can remove it in any comment. You may not do business with this license, sell it or charge for it.
This license is for you to use the service to buy and sell products online, non-exclusive and revocable for personal use.
This LICENSE will remain in force until you or SERJIS cancel it or until the PLATFORM is available to the USERS.
SERJIS retains ownership of all copies of the software applications and their content.
15.1° YOU DO NOT HAVE A LICENCE FOR THE USE OF BRANDS AND COMMERCIAL NAMES.
You do not have a license, nor any right to:
The brand, slogan or other identifiers of SERJIS whether registered or not, as these are the property of SERJIS.
Other registered trademarks, service marks, trade names and logos appearing on the PLATFORM belong to their respective owners ("THIRD PARTY MARKS").
Therefore the USER shall avoid using any of these marks without authorization.
16° WE MAY CONTAIN LINKS TO THIRD PARTY WEBSITES.
The PLATFORM may contain links to third party websites ("THIRD PARTY SITES"). Therefore you agree that:
We have no control over such THIRD PARTY SITES.
We are not responsible for the availability of these or for the services, content, advertising, products or any materials available on them.
We shall not be responsible, directly or indirectly, for any damage or loss that is caused by the use of any services, content, products or other materials available through the THIRD PARTY SITES.
The THIRD PARTY SITES are governed by their corresponding Terms and Conditions of Use and Privacy Policy, and the USER must know and accept such documents before using them.
17° THE AVAILABILITY AND FUNCTIONALITY OF THE PLATFORM DEPENDS ON MANY FACTORS.
The availability and functionality of the PLATFORM depends on many factors, such as communication networks, software, hardware and service providers and contractors.
Because of these factors, you should be aware that we cannot guarantee that the application will work at all times without interruption. But we guarantee that we will do our best to ensure that the PLATFORM is working and in good condition, so that you can access it without any problems.
18° WE CAN HAVE SPONSORED ADS.
We may have sponsored ads, if you click on an ad it may happen that:
You will be transferred to an advertiser's website. You will be able to receive messages, information and offers.
All the information contained in the advertisements belongs exclusively to the advertisers. SERJIS has no representation in such advertisements, nor does it have control over such advertisements.
Advertisers or related third parties may be entitled to certain earnings from such advertisements. The USER accepts and acknowledges that it has no rights, and that no guarantees will be given to it with respect to the earnings from the advertisements.
19° RESPONSIBILITY FOR THE USE OF THE PLATFORM.
The use of the PLATFORM is your sole responsibility and at your own risk. Consequently, you must take into account that:
We will not be responsible for any damages arising from any event due to the use or inability to use the application.
We do not intend to limit liability or alter your rights as a consumer that cannot be excluded under applicable law.
You agree to be liable to SERJIS for any claims, suits, losses, liabilities and expenses (including attorneys' fees) arising from:
- The use of the Services obtained through the PLATFORM.
- Your breach or violation of any of these CONTRACTS.
- Your violation of the rights of any third party.
20° OUR TERMS MAY CHANGE, YOU MUST BE AWARE.
The Terms and Conditions and the Privacy Policy of SERJIS may be revised and updated from time to time, with or without prior notice, for which reason you are advised to visit this page frequently. In the event of any material change, SERJIS will endeavour to publish a notice of such change on the Application.
Any changes to the Privacy Policy will be effective from the "last update".
21° COOKIES.
By accessing or using the application, SERJIS can use technologies such as "cookies" (or similar technologies) which stores certain information on the User’s computer ("Local Storage"). These technologies allow automatic activation of certain features and better use of the service.
The cookies used in the service are created per session, does not include any information about the User, except the session password, which is removed at the end of the session in the Application (usually after 24 hours). Most browsers allow the User to erase cookies from the hard drive, block cookies of acceptance, or receive a warning before a cookie is stored. To delete or disable the Local Storage, the User must use the configuration option according to the instructions provided by the technology provider. However, if the User blocks the cookies or deletes them, the online experience of the User can be limited.
SERJIS can use certain third-party cookies each time the User visits the application or when visiting other websites that use similar cookies without fluctuating the Service of the Platform. The third-party cookies are stored only as Non-Personal Information, such as history of websites visited, and duration of browsing, etc.
22° WEBSITE DISPUTES.
If there is any dispute between the USER and SERJIS in relation to these TERMS, the parties agree to bring the differences before the Court of Medellin, Colombia and accept that this court shall have jurisdiction to resolve the litigation of any claim.

24° GENERAL.
These Terms and Conditions shall not be construed as a relationship, partnership, joint venture, employee-employer between SERJIS and the User or related third parties.
Any claim relating to their use shall be governed by the laws in force, decisions, treaties and other Colombian legal documents and provisions relating to intellectual property, data protection and other materials related to services or applications on the Internet.
These terms constitute the current Terms and Conditions and replace any other agreement previously written between the User and SERJIS.
The validity of these TERMS is for the time of use of the PLATFORM by the USER.
